1. Acceptance of Terms

By accessing and using instantproof.legal (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Service Description

instantproof.legal provides digital evidence certification services. The Service allows users to create RFC 3161-compliant qualified timestamps and advanced electronic signatures for files, web pages, and browser sessions. These certificates include:

  • SHA-256 content hashing
  • RFC 3161 qualified timestamp responses
  • Advanced electronic signature (eIDAS-compliant)
  • PDF certificate of authenticity
  • Metadata archives and manifest files

The Service is compliant with EU Regulation 910/2014 (eIDAS) and operates under Belgian law.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

5. Permitted Use

You agree to use the Service only for lawful purposes and in compliance with applicable laws. You shall not:

  • Certify content that violates third-party intellectual property rights
  • Certify content intended for fraud, deception, or blackmail
  • Certify content that violates privacy laws or regulations
  • Attempt to reverse-engineer, hack, or disrupt the Service
  • Use the Service for any unlawful or harmful purpose

6. Data Deletion Rights

Users may request deletion of their data at any time. Upon request, we will permanently delete all personal data associated with your account within 30 days, except where retention is required by law. Downloaded certificate packages remain the property of the user and are not affected by account deletion.

7. Intellectual Property

All content, features, and functionality of the Service (including but not limited to software, source code, logos, and designs) are the exclusive property of instantproof.legal and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to use the Service for your personal or business purposes.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either expressed or implied. We disclaim all warranties, including:

  • Merchantability or fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, completeness, or timeliness of content
  • Uninterrupted or error-free operation

No advice or information provided by us creates any warranty not expressly stated in these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, instantproof.legal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service — even if we have been advised of the possibility of such damages.

Our total liability for claims arising from your use of the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

10. GDPR Compliance

As a data controller, instantproof.legal is committed to compliance with the General Data Protection Regulation (GDPR). You have the right to:

  • Erasure of your data (Art. 17)
  • Restrict processing (Art. 18)

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Belgium, without regard to conflicts of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective 30 days after posting on this page. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
